Adopt a resolution approving the California State Water Resources Control Board Amendment No. 3 to Agreement No. SWRCB0000000000D1902047 increasing the grant amount by $700,000 for a total not-to-exceed amount of $9,074,888; approving a budget appropriation of $1,389,007 to Fund 690 and amend the FY 25 Capital Improvement Program for the Nile Garden Well 30 Construction Project (CIP 21034); approving a Project Budget Contingency of $1,389,007 for both CIPs 21026 and 21034; and authorizing the City Manager or designee to take all appropriate actions necessary to carry out the purpose and intent of the resolution.

Background:
In 2015, the City of Manteca (“City”) and the Manteca Unified School District collaborated with NV5 to secure a grant totaling $4,963,845 from the State Water Resources Control Board (“SWRCB Grant”), see Attachment 6, to construct Well 30 and all ancillary equipment needed to provide drinking water to Nile Garden Elementary School (“CIP 21026 & CIP 21034”) (“Project”). NV5 was compensated $70,263 by the City for their service. The Project is comprised of the following two phases:
- Phase 1 includes the drilling and development of the new potable water Well 30 at the southmost corner of Palmer Park.
- Phase 2 includes the installation of the well pump, building, ancillary equipment, arsenic treatment system, connection to the City’s existing distribution system, and water lines to Nile Garden Elementary School.
In 2020 the SWRCB Grant was issued to the City. On January 18, 2022, City Council approved Amendment No. 1 to extend the SWRCB Grant for 18 months, see attachment 5.
On September 20, 2022, City Council approved a professional service agreement with Wood Rodgers, Inc. (“Wood Rodgers”) for the preparation of plans, specifications, and estimates (“PS&E”) in the amount of $505,447.
On April 4, 2023, City Council approved the PS&E for Phase 1 of the Project and authorized a Call for Bids.
On June 20, 2023, City Council approved a construction contract with Nor-Cal Pump & Well Drilling (“Nor-Cal Pump”) in the amount of $927,853; and a professional service agreement with Brown & Caldwell (“B&C”) for construction management and inspection services (“CM&IS”) in the amount of $206,867.
On September 19, 2023, City Council approved the PS&E for Phase 2 of the Project and authorized a Call for Bids.
On December 5, 2023, City Council approved Amendment No. 1 to the professional service agreement with Wood Rodgers for additional tasks and construction support for the Project in the amount of $10,500.
On March 5, 2024 the City Council approved a construction contract with T&S Construction, Inc. for the construction of Phase 2 of the Project in the amount of $4,925,000 and Amendment No. 1 for CM&IS with B&C in the amount of $674,044. In May 2024 the State approved Amendment No. 2 to the SWRCB Grant adding an additional $3,411,043 to the reimbursable grant amount, see attachment 4.
In March 2024, during the drilling of Well 30, the surrounding soil started to cave in. Drilling work was paused while a Geotechnical Engineer (“GE”) evaluated the soil conditions. The GE recommended design changes to the building, arsenic treatment system, electrical conduits, and changes to onsite piping.
During construction conflict with existing utilities were discovered that were not known or identified during the design phase; additionally, San Joaquin County Public Works (“SJC”) required changes to the pipe material based on the depth specified in the plans to meet their standard as the utility is in their roadway.
On August 20, 2024, the City Council approved Amendment No. 2 to the professional service agreement with Wood Rodgers for the Project and increased the maximum not-to-exceed compensation by $200,000.
In February 2025 the City requested an additional $700,000 from the State Water Board to cover the additional costs related to the GE recommendations, utility conflicts, and the change in pipe material to meet SJC standards.
In May 2025, the State Water Board submitted a draft Amendment No. 3 to the SWRCB Grant approving the additional $700,000 in funding, see attachment 3.
Fiscal Impact:
Staff recommends Council approve the California State Water Resources Control Board Grant Amendment No. 3 in the amount of $700,000 for a total grant amount not-to-exceed of $9,074,888. Approve a budget appropriation of $1,389,007 to Fund 690 and Amend the FY25 Capital Improvement Program for the Nile Garden Well 30 Construction Project (CIP 21034). Approve a Project Budget Contingency of $1,389,007 for both CIPs 21026 and 21034.
