Subject: Second Extension for Aretakis Tentative Parcel Map
Conduct a public hearing and find a map exempt from further environmental review pursuant to Section 15315 of the California Environmental Quality Act Regulations and adopt a resolution approving a second one-year extension for Tentative Parcel Map (SDN 21-128) located at 1437 & 1533 South Main Street (APNs: 224-021-16 and -224-021-17).
PROJECT DESCRIPTION:
The Project was initially approved on February 17, 2022, based on the analysis and findings provided in the staff report included as Attachment 1. The applicant was granted a one-year extension on April 18, 2024. Presently, the applicant is request a second one-year extension. There are no proposed changes to the approved tentative parcel map therefore the analysis and findings provided in Attachment 1 remains unchanged.
The approved Tentative Parcel Map entails dividing two parcels both zoned Commercial-Mixed Use (CMU) with a matching General Plan designation. The two parcels have a combined gross of 45.73-acres that will be separated into four smaller parcels and a remainder lot. Lot 1 will be 1.9 acres and Lots 2, 3, and 4 will be approximately 1.00 acre each. The remainder lot will be 41.95 acres. Conditions of Approval for the SDN 21-128 include right-of-way and public utility easement dedications that will allow access to the interior lots. There was no development approved as part of this map, nor has there been subsequent approval for development.
PROJECT LOCATION
The Project is located on the northwest corner of the intersection of West Atherton Drive and South Main Street, at 1437 & 1533 South Main Street (APNs No. 224-021-16 and 224-021-17).
PROJECT BACKGROUND
This Project was approved by the Planning Commission on February 17, 2022. On April 18, 2024, the Planning Commission approved a one-year extension of the Tentative Parcel Map subject to the originally approved conditions with an expiration date of April 18, 2025. If approved, this will be the second extension of SDN 21-128.
ENVIRONMENTAL REVIEW
The Project is determined categorically exempt from the requirements of California Environmental Quality Act (CEQA) pursuant to Section15315 “Minor Land Divisions”, of the CEQA Guidelines, as this is the division of property into four or fewer lots, the division is in compliance with the General Plan and Zoning Ordinance, all City services are available, the parcel was not involved in a division of a larger parcel within the past 2 years, and the parcel does not have an average slope of greater than 20 percent.
