Background:

The City Council approved the Final Map and Improvement Agreement for Yosemite Greens on February 15, 2022. Yosemite Greens subdivided approximately 14 acres of land into 99 residential lots, a park/storm drain basin lot, and public rights-of-way. The estimated cost of the improvements is $5,428,384.36, as included in the Improvement Agreement.

 

The installed improvements include all underground utilities (both wet and dry), curb, gutter, sidewalk, street pavement, street markings, street signage, street lighting, sewage systems, storm drainage systems, water systems, perimeter fencing and the park. 

 

The public improvements for the Yosemite Greens have been completed in accordance with the approved improvement plans. Refer to the attached memorandum from the City Construction Inspector (Attachment 2).

 

As a condition of approval for this project the Developer (DR Horton) was required to pipe the Drain 5 canal located centered on the project’s southern property line. To complete this work the Developer would need to acquire permission, and grant of easement to the City, from the adjacent property owner since the Drain 5 canal is centered on the common property line. Per the conditions of approval, the Developer could defer these required improvements if they paid their proportionate cost share of the required work plus 25% markup to account for inflation since the actual work will be completed in the future having increased construction costs. The Developer requested to defer the work and submitted a payment of $902,364.16 to the City representing their fair share of the required work including the 25% markup, thus satisfying the condition of approval. When the work is eventually completed in the future, if the actual construction cost is less than what was paid, any remaining balance will be refunded to the Developer.    

 

In accordance with the City of Manteca Municipal Code, the Performance Bond will be exonerated upon acceptance of the improvements by City Council and submittal of a Warranty Bond. The Labor and Materials Bond will be exonerated six (6) months after the date of acceptance if no claims have been received by the City for lack of payment. The Warranty Bond will be exonerated twelve (12) months after the date of acceptance, once the improvements have been re-inspected and the work is found to be in good condition as determined by the City Engineer or any defects have been repaired.

 

Fiscal Impact:

There is no fiscal impact with this action.
