Recommendation:

title

Adopt a resolution determining that the proposed disposition of City-owned property located at 1403 W. Atherton Drive conforms to the City of Manteca General Plan pursuant to Government Code Section 65402(a)

body

Background Information:

The City owns approximately 161,349 square feet (3.70 acres) at 1403 W. Atherton Drive. The City is considering a Purchase Agreement with Drake Manteca LLC for $4,000,000 for the property. The buyer anticipates pursuing a build-to-suit facility for Tesla, Inc. The City Council will separately consider approval of the Purchase Agreement.

General Plan Consistency:

Government Code Section 65402(a) requires the planning agency to review and report on the conformity of the location, purpose, and extent of a proposed City real property disposition with the adopted General Plan.

The proposed disposition of approximately 3.70 acres of City-owned property at 1403 W. Atherton Drive to Drake Manteca LLC is intended to facilitate private commercial investment and the productive development of the property consistent with the site’s Commercial (C) General Plan land use designation. The C land use designation accommodates neighborhood, community, and regional-serving retail and service uses, including auto-serving commercial uses and other similar and compatible activities. Transferring the property to private ownership would retain the existing land use designation and provide an opportunity to develop the site for its planned commercial purposes. Any future development would remain subject to applicable land use regulations, development standards, and required City approvals consistent with the site’s underlying General Commercial (CG) zone district.

The disposition, through future private development, advances the general objectives of the City's 2024 General Plan, including Goal LU-1, which promotes an appropriate distribution of land uses; Goal LU-2, which supports orderly development and efficient use of existing infrastructure; and Goal EF-3, which encourages business attraction and expansion and promotes economic development.

The proposed action transfers City ownership of the parcel for potential private development. Based on the identified land use designation and applicable policies, staff finds the location, purpose, and extent of this disposition consistent with the General Plan, subject to confirmation of the designation and policies above. This determination does not approve the proposed Tesla facility, establish permitted uses, or authorize any development.

ENVIRONMENTAL DETERMINATION:

This action addresses only General Plan conformity of the proposed disposition which does not involve the approval of disturbance or development of the site, therefor this action is exempt from the provisions of the California Environmental Quality Act (CEQA) pursuant to State CEQA Guidelines Section 15061(b)(3), the "Common Sense" Exemption. This exemption applies to projects where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. Any subsequent discretionary approvals for development will undergo separate review under the California Environmental Quality Act (CEQA), as applicable.
