Approve partial acceptance of public improvements for S. Union and Woodward, Tract 4109 located at the southeast corner of the S. Union Road and W. Woodward Avenue intersection, in accordance with the Subdivision Partial Acceptance Policy.

Background:
The City Council approved the Improvement Agreement and Final Map for S. Union and Woodward on September 6, 2023. S. Union and Woodward subdivided approximately 3.60 acres of land into 13 residential lots, a storm drain lot and public rights-of-way. The estimated cost of the improvements is $784,117.11, as included in the Improvement Agreement.
The installed improvements include all underground utilities (both wet and dry), curb, gutter, sidewalk, street pavement, street markings, street signage, street lighting, sewage systems, storm drainage systems, water systems and perimeter fencing.
Cecil Mitchell Equities, Inc., developer of the S. Union and Woodward subdivision, has requested to construct and occupy completed homes prior to final acceptance of the subdivision public improvements. This partial acceptance will establish legal access to all parcels but does not accept maintenance of the public improvements, which will remain with the Developer. This partial acceptance does not initiate the one-year warranty period for the improvements. The warranty period begins with the final acceptance of the public improvements.
Public improvements necessary for the ingress and egress and the public utilities have been completed in accordance with the approved plans. There are no health and safety items outstanding.
The City will retain possession of the Performance Bond; the one-year warranty period on all of the public improvements will not commence until all of the improvements are completed and the City Council approves exoneration of the Performance Bond.
It is recommended to approve partial acceptance of public improvements in accordance with the Subdivision Partial Acceptance Policy, Resolution 2008-150, at S. Union and Woodward, Tract 4109, with the condition that the Performance Bond will be retained until all public improvements are completed to the satisfaction of the City Engineer and the Engineering Department.

There is no fiscal impact associated with this action.
