Background:

The City and MetroPCS California, LLC, or their predecessors, entered into a Communications Site Lease Agreement dated October 18, 2011, for space at 208 East Wetmore Street. The proposed first amendment would replace the existing renewal schedule and revise rent and certain administrative terms.

 

The amendment grants the lessee seven additional five-year renewal terms beginning October 1, 2026. Rent will be $2,600 per month beginning that date. It will increase by 15 percent on October 1, 2031, and at the start of each subsequent five-year renewal term. If the lessee remains after the agreement ends, the lease will be converted to a month-to-month tenancy on the same terms.

 

MetroPCS would continue to use the tower space for its communications equipment. The lessee would maintain its leased space and equipment, while the City would maintain the remainder of the property, including City-owned support structures and common areas where applicable. The amendment addresses notice for assignment or subleasing, cooperation on permits, a 12-month deadline for the City to bill non-rent charges, and updated notice addresses. Other provisions of the existing lease remain in effect unless they conflict with the amendment.

 

 

 

Fiscal Impact:

Rent will be $2,600 per month beginning October 1, 2026, equal to $31,200 for each full year at that rate. The first 15 percent increase on October 1, 2031, will raise rent to $2,990 per month, or $35,880 for a full year at the new rate. The proposed lease amendment will generate revenue to the Innovation and Technology Fund (Fund 350).
