Background:

The Zone 36/39 Storm Drain Improvements Project (CIP 20004) includes a sixty-six-inch (66”) gravity storm drain line within Woodward Avenue to property owned by Reclamation District 17 (RD 17) on Aplicella Court.  From the RD 17 property, a pump station and forty-eight-inch (48”) force main will carry the storm runoff to the former Oakwood Lake Water District corporation yard and over the levy to an outfall structure on the San Joaquin River.

 

On January 21, 2020, the City Council authorized the expenditure and execution of an Agreement for Professional Services with Dewberry in an amount not-to-exceed $1,191,268 for the Zone 36/39 Storm Drain Improvements Project for Engineering, Environmental, and Permitting Services.

 

The outfall structure on the San Joaquin River has a narrow window of construction in accordance to the environmental permitting that would preclude in-water construction on the outfall from November 1st through July 31st.

 

On January 5, 2022, the City Council authorized an increase in expenditure and execution of Amendment No. 1 (C2020-10-A1) to the Agreement for Professional Services with Dewberry up to $1,384,868 for additional permitting assistance and other related efforts.

 

On December 22, 2022, the City Council authorized the execution of Amendment No. 2 (C2020-10-A2) to the Agreement for Professional Services with Dewberry extending the Time of Performance to December 31, 2023, due to the COVID-related delays in State and Federal permits application processing.

 

On November 21, 2023, the City Council authorized the execution of Amendment No. 3 (C2020-10-A3) to the Agreement for Professional Services with Dewberry extending the Time of Performance to December 31, 2025, due to protracted State and Federal permit reviews and processing.

 

Over the course of this past year, Dewberry has completed construction drawings and accompanying specifications, including completing the additional services and alternative analysis studies requested by the agencies. Very recently the San Joaquin Area Flood Control Agency (SJAFCA) published a new report requiring an increased Design Water Surface Elevation (DWSE) and Reclamation District 17 consequently advised the City the project needs to update the design accordingly. As such, Dewberry will need to revise the project plans and coordinate this change with the permitting agencies. The contract term is being extended to allow for revising the design as well as for design support during construction.

 

Fiscal Impact:

Amendment No. 4 to Agreement C2020-10 with Dewberry Engineers, Inc. increases the contract amount by $206,450 from $1,384,868 to $1,591,318 and extends the term to June 30, 2027. The additional funding required for this amendment will be paid from the PFIP Drainage Fund (Fund 580). Sufficient appropriations are available within the project budget to support this amendment.

 

There is no General Fund impact.
