Adopt a resolution authorizing the filing of the low Carbon Transit Operations Program Application for Youth Free-Fare Days (LCTOP), execution of the Certifications and Assurances and Authorized Agent Forms. accepting grant award in the amount $49,332, amending the Fiscal year 2024-25 budget, authorizing a budget appropriation in Fund 610 Federal Transit Management; and ; authorize the City Manager or designee to execute all required documents and any amendments thereto with the California Department of Transportation and any budget adjustments necessary to expend applicable grant funds or take all appropriate actions to carry out the purpose and intent of this resolution.

Background:
The Low Carbon Transit Operations Program (LCTOP) is one of several programs that are part of the Transit, Affordable Housing, and Sustainable Communities Program established by the California Legislature in 2014 with Senate Bill 862 (SB 862). SB 862 established LCTOP as a noncompetitive, formulaic program, with 5% of annual auction proceeds being continually appropriated at the beginning of 2015. LCTOP funds are distributed based on prior use of State Transit Assistance (STA) funds where 50% of the funds are designated to regional entities and the other 50% for transit operators. LCTOP was created to provide operating and capital assistance to transit agencies with the goal of reducing greenhouse gas (GHG) emissions and improving mobility, with an emphasis on serving Disadvantaged Communities DAC(s).
For FY 24/25, a total of $2,045,568 was awarded to the San Joaquin County region via PUC 99313 distribution formula, for dispersal by San Joaquin Council of Governments (SJCOG) the City is anticipated to receive $1,382 from revenue-based apportionment (99314) directly and $47,950 from population-based apportionments (99313) from (SJCOG).
LCTOP funds are available to transit agencies for operating and capital assistance that reduce GHG emissions and improve mobility, with priority on serving disadvantaged communities; and meets the following:
1. Expenditures that directly enhance or expand transit service by supporting new or expanded bus or rail services, new or expanded water-borne transit, or expanded intermodal transit facilities, and may include equipment acquisition, fueling, and maintenance, and other costs to operate those services or facilities.
2. Operational expenditures increase transit mode share.
3. Expenditures related to the purchase of zero-emissions buses, including electric buses, and the installation of the necessary equipment and infrastructure to operate and support zero-emission buses.
Eligible Recipients must have the financial means to maintain and operate project services and the ability to accept their legal liabilities and fulfill financial obligations for the project’s useful life
The Certifications and Assurances document contains general conditions of the LCTOP program as well as reporting, cost principles, and record retention requirements that are standard for State-funded projects.
The LCTOP guidelines require regional entities and transit operators who expect to receive LCTOP funds to assign an Authorized Agent or Agents to be the signatory on any documents associated with obtaining and managing LCTOP funds.
It is anticipated that the City will use these funds to offer free fares for youth on Manteca Transit to attract new riders, increase ridership and reduce greenhouse gas emissions to improve mobility, which is a priority for serving disadvantaged communities
Fiscal Impact:
Staff recommends amending the fiscal year 2024-25 budget and approving the budget appropriation to Fund 610 Federal Transit Management for the Low Carbon Transit Operations Program (LCTOP) in the grant award amount of $49,332 for Youth Free-Fare Days program; Authorizing the City Manager or designee to execute all associated documents and take all appropriate actions to carry out the purpose and intent of this resolution.
