Adopt a resolution approving Amendment No. 1 to the Improvement Agreement for 320 Airport Way Subdivision, Tract 4165, modifying SCHEDULE B, Section IV, Sewer Collection System Reimbursement, decreasing the amount listed as Total Sewer Collection System for the Central Union Road Trunk Extension Capital Improvement Program Project (CIP #24004) Reimbursement from $2,121,770.16 to $1,969,395.57; and authorizing the City Manager to sign and take all necessary steps to effectuate Amendment No. 1.

Background:
On December 3, 2024, the City of Manteca and 320 Airport Way, LLC, entered into an Improvement Agreement for the 320 Airport Way Subdivision, Tract 4165 (C2025-08) with the Estimated Total Cost of Improvements of $9,691,400.65.
The 320 Airport Way Subdivision improvement plans included widening N. Airport Way, constructing a new segment of Center Street, and installing frontage improvements, and were reflected in Schedule B of the Improvement Agreement.
Portions of these improvements are included in Schedule B and are eligible for reimbursement. During construction of the approved improvements, additional sewer bypass work and night security monitoring were included and the dewatering quality treatment item of work was removed because the groundwater was retained on-site and not discharged.
Based on these changes, the amended SCHEDULE B, Section IV, Sewer Collection System Reimbursement amount is revised down from $2,121,770.16 to $1,969,395.57, a net difference of $152,374.59.
Fiscal Impact:
In accordance with the Improvement Agreement for the 320 Airport Way Subdivision, Tract 4165 (C2025-08), the City shall reimburse the Developer its cost to install portions of the City’s Sewer Collection system.
By approving this Amendment No. 1, the total eligible reimbursement amount for the Sewer Collection System for the Central Union Road Trunk Extension Capital Improvement Program Project (CIP #24004) Reimbursement, will decrease to $1,969,395.57.
