Recommendation:

Adopt a resolution ratifying the emergency Purchase and Contract with Champion Industrial Contractors, Inc for the Animal Shelter Cooling System Replacement in an amount not-to-exceed $130,957, with a 10% contingency of $13,095.70 and authorize the City Manager to execute the agreement and any associated documents consistent with the City's Purchasing Policy.

Background:
Due to the excessive heat experienced in early August, the cooling system at the Animal Shelter failed, creating an emergency condition requiring immediate action. The loss of adequate cooling presented an unacceptable risk to the health and welfare of the animals housed at the facility, particularly given the extreme summer temperatures.
The Animal Shelter requires continuous and adequate climate control, delaying corrective action through the City's normal procurement process would have unnecessarily prolonged the emergency and increased the potential risk to the animals, staff, and City operations.
Staff evaluated the available options and determined that replacement of the failed cooling system with a new 30-ton cooling unit was the most appropriate long-term solution. As part of the evaluation process, the required 14-day load test at the Animal Shelter was successfully completed, confirming that the facility is ready to proceed with installation of the replacement unit.
Staff obtained quotes for the replacement and installation of the cooling system. Based on the proposals received, Champion Industrial Contractors, Inc provided the most cost-effective option and was determined to provide the best value to the City based on overall cost, equipment availability, and its ability to promptly restore adequate cooling at the facility.
Staff recommend that the City Council ratify the emergency procurement and authorize the replacement of the failed cooling system at the Animal Shelter. Specifically, staff recommends ratification of the agreement with Champion for the purchase and installation of a new 30-ton cooling unit in an amount not-to-exceed $130,957, with a 10% contingency of $13,095.70 for unforeseen conditions and potential duct detector modifications.
Approval of the recommended action will allow the City to address the emergency conditions, restore reliable climate control at the Animal Shelter, and provide an appropriate long-term cooling solution for the facility.
Fiscal Impact:
There are sufficient funds in Measure Q (Fund 105) utilizing CIP 24027 - Citywide Facilities Maintenance & Upgrades for this agreement.
