Background:

The Denali residential development (Denali) is located in the southwest part of the City of Manteca (City), outside the jurisdictional boundary of the South San Joaquin Irrigation District (SSJID) and is not currently able to discharge stormwater. As part of the City‘s approval of the Denali development, the City conditioned TH Denali LLC (Developer), to provide for the development’s storm drainage. However, the oversized stormwater retention basin that was constructed is not percolating as designed. Consequently, a temporary alternative solution is necessary to provide for the development’s storm drainage through the current wet weather season while the City works with the developer to bring the basin into compliance.

 

City staff have been working with the Developer to find a viable solution and identified the potential to run a temporary storm line from the basin to the SSJID Drain 8, where the basin water could be pumped/discharged to the French Camp Outlet Canal (FCOC), as needed, contingent upon SSJID’s approval and downstream capacity in the FCOC. The Developer is agreeable to this solution. City staff and SSJID have worked to prepare an agreement between the two agencies. As the associated costs to discharge into SSJID’s system and other stipulations required by SSJID will be borne by Developer, City staff have also worked with the Developer to prepare an improvement agreement whereby Developer will effectively agree to SSJID’s terms and conditions. In addition, the Improvement Agreement will require a performance bond to ensure Developer completes improvements to the basin necessary for it to function as designed and in accordance with City requirements.

 

Fiscal Impact:

There is no fiscal impact associated with this item. Once the improvements are accepted by the City, the maintenance of the infrastructure will be the City’s responsibility, which will be funded through the development’s participation in a community facilities district or other funding mechanism.
