Adopt a resolution approving grading and construction of improvements prior to filing of the Final Map for the Trails of Manteca Subdivision.

Background:
On February 15, 2011, City Council conditionally approved The Trails of Manteca Tentative Subdivision Map. The Tentative Map proposed to subdivide approximately 300 acres of vacant land into 1,178 single-family residential lots, 192 townhomes/garden apartments, and 280 apartments.
In accordance with the Manteca Municipal Code (MMC) Title 16 Section 16.13.060, a subdivider may request approval from the City Council to start improvement work related to a subdivision prior to the approval and recordation of the Final Map.
Manteca Trails, LLC, developer of the Trails of Manteca Subdivision, has submitted a written request to begin work on the subdivision prior to recordation of the future Final Maps. All conditions of MMC Title 16 Section 16.13.060 (B)(1) through (B)(5), copied below, will be met prior to the start of work.
Title 16, §16.13.060 (B) Grading and Improvements prior to Final Map states, “No improvement work shall occur and no permit shall be issued for any improvement work on any land in a subdivision or on any improvement for a subdivision prior to approval and recordation of the Final Map unless all of the following conditions are met:
1. The subdivider has made written application to the Engineering Department and has obtained approval from the City Council for such work;
2. The tentative subdivision map has been approved or conditionally approved;
3. Any re-zoning to make the lots conform to the city zoning ordinance has been approved; and
4. All improvement plans and grading plans have been approved and appropriately signed pursuant to this chapter; and
5. The City Council has by resolution determined that the approved work is not likely to cause substantial environmental damage, is not likely to substantially and avoidably injure fish or wildlife or their habitat, is not likely to cause serious public health problems and is not likely to injure any nearby property, whether the subdivision is completed or abandoned.”
In accordance with the conditions copied above, the City Engineer will approve and sign the Improvement Plans prior to the start of improvement work for the future units of the subdivision.
Fiscal Impact:
There is no fiscal impact associated with this proposed action.
