Memo to:

Manteca City Council

From:

Stephanie Van Steyn, Director of Human Resources

Date:

October 21, 2025

Subject:

Americans with Disabilities Act (ADA) Consulting Contract

Recommendation:

title

Adopt a resolution approving a Contract for Services Agreement with Disability Access Consultants, LLC (“DAC”), in an amount not-to-exceed $200,000 and authorize the City Manager to execute the agreement.

body

Background:

The City is required to comply with the Americans with Disabilities Act (ADA); the Rehabilitation Act of 1973 (Section 504), as amended; California Government Code Sections 11135-11139.5; title 24 of the California Code of Regulations; and other applicable federal, state and local laws and regulations protecting the rights of Qualified Individuals with a Disability.

Part of the criteria for receiving funding from CalTrans and/or the Federal Department of Transportation is that the City maintain and make progress toward its ADA Transition Plan.  This Plan requires the City to conduct public outreach, inspect facilities, parks, sidewalks, streets, other public areas, and identify a schedule for improvements in order to be ADA compliant.

In 2022, the City underwent an ADA assessment by CalTrans.  After that assessment, and in the following years through early 2025, the City was placed on a corrective action plan and was issued specific required corrective action items that had to be addressed to ensure compliance with the ADA and Section 504 of the Rehabilitation Act of 1973.

The City has been working with Disability Access Consultants, LLC (DAC) who has provided expert consulting services in assisting the City with planning, completing and responding to the action items required by CalTrans. In May 2025, CalTrans confirmed that the City was no longer on a corrective action plan and was in compliance with the ADA and Section 504. However, annual updates to CalTrans are required to ensure that the City progresses with its ADA Transition Plan.

Pursuant to the City Council Goals and Priorities for the Human Resources Department in Fiscal Year 2025-26, the ADA Transition Plan was included as a top priority.  The work that needs to continue under the ADA Transition Plan is cross-functional, as it involves working with other City departments including, but not limited to Engineering and Public Works.

In September 2025, DAC provided the City an updated scope of work for continuing work on the City’s ADA Transition Plan, including the required inspections.  The scope of work will span across a three-year period for a contract total not to exceed $200,000.

Fiscal Impact:

The Human Resources Department anticipated increased professional consulting fees for the current fiscal year, including with DAC.  There is no budget appropriation required for Fiscal Year 2025-26.  Human Resources staff will ensure the necessary ADA consulting costs are budgeted each fiscal year thereafter as well.
