Waive the first reading by substitution of the title and introduce and Ordinance of the City Council of the City of Manteca, State of California, amending Chapter 2.28 “Recreation and Parks Commission” of the Manteca Municipal Code to augment the responsibilities and authority of the commission.

Background:
At the September 3, 2024 and October 1, 2024 regularly scheduled City Council meetings, respectively, the City Council provided council consensus and direction to the City Attorney’s Office to review the City’s municipal code regarding the Recreation and Parks Commission, including updates to Chapter 2.28 to increase the responsibilities and oversight of the commission, consistent with other jurisdictions.
In September 2024, the City amended Chapter 2.28 of the Municipal Code with the intent to permit district appointments; however, the Council provided additional direction to look to the functionality of the commission and consider how it operates regarding increased responsibility and oversight for commission members.
The City Attorney’s Office reviewed the municipal codes relating to parks and recreation commissions of other jurisdictions to see how those commissions function. In addition, the City Attorney’s Office conferred with City recreation staff who oversee the commission currently to get their insight and suggestions.
The proposed ordinance amendments provide more oversight and responsibilities to the commission, including quasi-judicial authority on certain matters, while at the same time, recognizing the importance of staff to manage the day-to-day operations of the departments.
