Adopt a resolution approving Amendment No. 2 to the Improvement Agreement for Griffin Park Unit No. 7, Antone Raymus Parkway, Tinnin Road Offsite Civil Improvements, Traffic Signal and Civil Improvements at S. Main Street and Woodward Ave, modifying SCHEDULE B, modifying Transportation System Public Facilities Implementation Plan (PFIP) Reimbursement, increasing the amount listed as Total Transportation Facilities PFIP Reimbursement from $4,471,997.19 to $4,675,894.93; and authorizing the City Manager or designee to sign and take all necessary steps to effectuate the amendment.

Background:
On June 20, 2023, the City of Manteca and Pillsbury Road Partners, LLC, entered into an Improvement Agreement for Griffin Park Unit No. 7, Antone Raymus Parkway, Tinnin Road Offsite Civil Improvements, Traffic Signal and Civil Improvements at S. Main Street and Woodward Ave (C2023-95) with the estimated total cost of improvements of $20,557,747.71.
The improvements covered by the Improvement Agreement include all underground utilities (both wet and dry), curb, gutter, sidewalk, street pavement, street markings, street signage, street lighting, sewage systems, storm drainage systems, water systems, a storm drain basin/park and a traffic signal.
Amendment No. 1 to the Improvement Agreement was approved on June 16, 2026. Its purpose was to revise the approved Schedule B to reflect refinements in the scope of work covered under the Improvement Agreement. Amendment No. 1 was presented to City Council with the approval of the Developer. However, after its approval the Developer notified the City of additional costs associated with the refined scope of work which necessitated this Amendment No. 2.
City staff concurred and have amended the Total Transportation Facilities System PFIP reimbursement amount from $4,471,997.19 to $4,675,894.93.
Fiscal Impact:
Approving the recommended Amendment No. 2 to the Improvement Agreement increases the developer's net reimbursement by $203,897.74. Sufficient funds are available in the PFIP Transportation Fund (Fund 590) to pay the increased reimbursement.
