Background:

PROJECT DESCRIPTION:

Revisions to the existing Mixed Use Commercial Zoning District (CMU) to include zoning-level development standards, including mixed-use performance standards, building heights, setbacks, lot coverage, floor area ratio (FAR) standards, open space requirements, off-street parking requirements, and other objective standards that would give clear guidance to proposed developments. Changes to the respective sections are outlined in red within Attachment 2.

 

Establishment of a new Mixed Use Downtown Zoning District (DMU) to include zoning-level development standards, including mixed-use performance standards, building heights, setbacks, lot coverage, floor area ratio (FAR) standards, open space requirements, and other objective standards that would give clear guidance to proposed developments. Changes to the respective sections are outlined in red within Attachment 3.

 

Revisions to corresponding sections ensure conformance with the 2043 General Plan Update adopted in February of this year.

PLANNING COMMISSION HEARING:

At the regular Planning Commission meeting on September 5, 2024, the proposed amendment was considered. The Planning Commission voted 3-2 to recommend approval of the project.  Concerns of the dissenting Commissioners centered on parking availability in the Downtown area, and parking requirements in the CMU and DMU zoning districts.  Dissenting Commissioners were concerned that parking is currently inadequate in the downtown area and that not having a parking requirement in the DMU zone would have a detrimental effect to existing and future businesses. A parking study was conducted showing that at nearly all times, there is sufficient parking within one or two blocks. A reduction in the parking requirement in the downtown will incentive local development in the downtown area and assist in the attraction of additional restaurant and entertainment uses. As the downtown continues to attract investment and grow, this requirement can be revisited to address future concerns.

 

ENVIRONMENTAL REVIEW                     

The proposed Zoning Code updates are subject to CEQA Guidelines, and it was determined that a Supplemental Environmental Impact Report (SEIR) is the appropriate level of review. As the lead agency for the project, the City engaged a consultant, AECOM, to prepare a Supplemental Environmental Impact Report (SEIR) for the City of Manteca Zoning Code Update (the “proposed project”) (SCH# 2024050901).   The SEIR will supplement the previously certified City of Manteca (City) 2043 General Plan Update EIR and Revised Addendum to the 2043 General Plan Update EIR (State Clearinghouse #2020019010).  The Final SEIR is attached as Exhibit “A” to the attached Resolution.
