Recommendation:

Adopt a resolution accepting Public Improvements for Rotten Robbie Fueling Station and Convenience Store at 1014 S. Airport Way (located on the southeast corner of Airport Way and Wawona Street); approving exoneration of the Performance Bond; approving exoneration of the Labor and Materials Bond six (6) months after the date of acceptance; and approving exoneration of the Warranty Bond twelve (12) months after the date of acceptance.

Background:
The City Council approved the Rotten Robbie Fueling Station and Convenience Store commercial development (Rotten Robbie) on August 17, 2022. An Improvement Agreement for constructing offsite transportation improvements was subsequently approved on December 3, 2024.
The offsite transportation improvements are located on S. Airport Way and Wawona Street and include: street widening and construction of a right turn lane; curb, gutter, and sidewalk ramps; streetlights; and traffic signal improvements at S. Airport Way and Wawona Street. Per the Improvement Agreement, the cost of these transportation improvements is $939,390.
The offsite transportation improvements for Rotten Robbie have been completed in accordance with the approved improvement plans. Refer to the attached memorandum from the City Construction Inspector (Attachment 2).
In accordance with the City of Manteca Municipal Code, the Performance Bond will be exonerated upon acceptance of the improvements by City Council and submittal of a Warranty Bond. The Labor and Materials Bond will be exonerated six (6) months after the date of acceptance if no claims have been received by the City for lack of payment. The Warranty Bond will be exonerated twelve (12) months after the date of acceptance, once the improvements have been re-inspected and the work is found to be in good condition as determined by the City Engineer or any defects have been repaired.
Fiscal Impact:
There is no fiscal impact with this action.
