Adopt a resolution approving Amendment No. 2 to Professional Service Agreement No. C2022-77 Construction Management and Inspection Services with WSP USA, Incorporated, for the SR120 / McKinley Avenue Interchange Project Capital Improvement Project 11034; extending the contract Time of Performance to June 30, 2025; increasing the maximum not-to-exceed compensation by $194,665 for a total not-to-exceed $3,146,285; and authorize the City Manager or designee to and take all appropriate actions necessary to carry out the purpose and intent of the resolution.

Background:
The City of Manteca (City), in cooperation with the California Department of Transportation (Caltrans), and the San Joaquin Council of Governments (SJCOG), partnered to construct a new State Route 120 / McKinley Ave Interchange (Project).
On June 7, 2022, the City Council awarded the Professional Services Agreement (Attachment 2) with WSP USA, Inc. (WSP) for $2,364,537 to provide Construction Management and Inspection Services (CM&IS) for the construction of SR120/McKinley Avenue Interchange project (CIP 11034).
On May 16, 2023, the City Council approved Amendment No. 1 (Attachment 3) with WSP for $587,083 to the CM&IS agreement due to construction delays associated with wet weather.
During construction, additional water and sewer utilities were added to the project to support the future growth of the area. The additional construction work extended the planned project end date, construction management and inspection services schedule. The City is processing the project’s closing documents with Caltrans and the contractor to finalize the administrative tasks of the project.
Amendment No. 2 would include additional contract budget and time needed to provide support for project close-out and administration including but not limited to construction punch list items, potential claims, coordination with Caltrans regarding work completed and acceptance of improvements.
Fiscal Impact:
There is sufficient funding in the Fiscal Year 2024-25 Capital Improvement Program budget for SR120 / McKinley Avenue Interchange Project Capital Improvement Program 11034 (Accounts 440.00.00.900-8150.41 and 590.00.00.900-8150.14).
There is no General Fund impact.
