PROJECT DESCRIPTION:
The project applicant requests a one-year extension of the approved Site Plan and Design Review SPA-21-137 for SoMa Apartments, a 210-unit apartment complex. The approved development includes 42 studio, 52 one-bedroom, 92 two-bedroom, and 24 three-bedroom apartments. Ten three-story residential buildings will contain approximately 24 units each. The site will also include a one-story office/clubhouse/gym and a small one-story pool house.
The Project was originally approved at the February 2, 2023 Planning Commission meeting, with an expiration date of February 2, 2025. On September 27, 2024, the State of California approved Assembly Bill 2729, which provides an automatic 18-month entitlement extension for housing projects with specific expiration parameters. The Project qualified for this extension and therefore was granted a new expiration date of August 2, 2026. The applicant subsequently submitted a request to the City of Manteca Development Services Department for a one-year entitlement extension in consistency with the requirements of MMC 17.08.120.C. Approval of this extension request will result in a new entitlement expiration date of August 2, 2027. If approved, this extension would be the a one-year extension as allowed under the municipal code.
The Conditions of Approval have been revised for the following reasons: 1) to update formatting, 2) to include additional off-site improvement requirements from the Engineering Department 3) to include new Fire Code requirements, and 4) to provide the new entitlement expiration date.
ENVIRONMENTAL DETERMINATION:
The Planning Commission adopted an Initial Study/Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program (SCH# 2022110608) prepared for the Project pursuant to Section 15074 of the California Environmental Quality Act (CEQA), for which a Notice of Determination was filed with the San Joaquin County Recorder’s Office and State Clearinghouse on February 27, 2023. Therefore, no additional environmental review is warranted at this time.
