Recommendation:

Adopt a resolution approving a Cost-Share Agreement between the City of Lathrop and the City of Manteca for Yosemite Avenue pavement improvements located within the City of Lathrop and in Union Pacific Railroad Right-of-Way for an estimated cost of $45,925.48; and authorizing the City Manager or Designee to take all appropriate actions necessary to carry out the purpose and intent of the resolution.

Background:
On July 29, 2026, the City of Manteca (Manteca) executed a construction contract with United Pavement Maintenance, Inc. for the Yosemite Ave Pavement Improvement Project (Project) from Walnut Ave west to the Manteca City limits at the UPRR right-of-way, also being the Lathrop City limits.
The City of Lathrop (Lathrop) recently completed pavement improvements on Yosemite Ave west of UPRR’s rail tracks but didn’t complete improvements of a small section of roadway, approximately 50 linear feet, east of the tracks but still within the Lathrop’s jurisdiction.
In order to have contiguous uniform pavement improvements along Yosemite Ave, it is necessary and most efficient to incorporate this work, located within Lathrop’s jurisdiction, into Manteca’s Project.
Per the proposed Cost-Sharing Agreement with Lathrop, Manteca will pay for this work to be completed by Manteca’s contractor and submit reimbursement to Lathrop for the actual costs incurred. The pavement improvements are estimated to cost $45,925.48, which Lathrop will pay 100% of the costs. Lathrop will issue a no-fee encroachment permit for the work to be completed within their right-of-way.
Fiscal Impact:
There is sufficient funding available in the Gas Tax/Street Improvement Fund (Fund 420) to cover the estimated expenditures. The City will be reimbursed for expenditures, so there is zero net financial impact under the agreement.
