Background:

In 2003, the City of Manteca (City) adopted its 2023 General Plan. The General Plan was amended in 2011 and 2016. When the City adopted its General Plan in 2003, and amended the General Plan in 2011 and 2016, the Yosemite Square Subdivision, included a park that would need a groundwater irrigation well.

 

In 2014, the California Legislature passed the Sustainable Groundwater Management Act (SGMA), which requires designated medium and high prior basins to prepare a Groundwater Sustainability Plan (GSP). SGMA also allowed for the creation of Groundwater Sustainability Agencies (GSAs) to manage the extraction of groundwater within their geographic limits. The Eastern San Joaquin Groundwater Basin (Basin) underlies much of San Joaquin County, including the City Of Manteca. In 2016, the City of Manteca became its own GSA, and later in 2017 it elected to become a member of the Eastern San Joaquin Groundwater Authority (ESJGA). In 2019, ESJGA Members adopted the Basin’s GSP with a goal to achieve sustainability in the Basin by 2040.

 

On March 29, 2022, Governor Gavin Newsom adopted Executive Order No. N-7-22 to address ongoing drought conditions, and included language that  counties, cities, or other public agencies not “approve a permit for a new groundwater well or alteration of an existing well in a basin subject to SGMA and classified as medium- or high-priority without first: 1) obtaining written verification from a GSA managing the basin or area of the basin where the well is proposed to be located; 2) that groundwater extraction by the proposed well would not be inconsistent with any sustainable groundwater management program established in any applicable GSP adopted by that GSA, and: 3) would not decrease the likelihood of achieving a sustainability goal for the basin covered by such a plan.

 

In March 2023, the Department of Water Resources (DWR) approved the Eastern San Joaquin Groundwater Basin GSP. When the ESJGA adopted its GSP in 2019, it considered the applicable general plans for all jurisdictions and planned groundwater usage.

 

In October 2024, the City received a new application for a groundwater irrigation well to irrigate the park within the Yosemite Square development, which is consistent with the City’s General Plan and requirement on the development.

 

This resolution allows the City Engineer or designee to make the required certification to San Joaquin County Department of Environmental Health, allowing them to begin the second step of certification prior to construction of the well in compliance with the terms of Executive Order N-7-22.
