Background:

On October 26, 2023, the City of Manteca and TH Denali, LLC, entered into an Improvement Agreement for Denali Unit No. 3 with an Estimated Total Cost of Improvements of $4,492,891.29.

 

After entering into the Improvement Agreement, there were revisions to the improvements for Denali Unit No. 3 including finalization of the design of the roundabout at the intersection of W. Woodward Avenue and McKinley Avenue and the addition of turn-outs along W. Woodward Avenue to improve the flow of eastbound traffic between Joshua Street and McKinley Avenue. These improvements are covered in the City’s Public Facilities Implementation Plan (P.F.I.P.), therefore the Developer is entitled to P.F.I.P. credits or reimbursements in the amount of $1,007,003.78 for installing these improvements.

 

The Improvement Agreement did not include Schedule B or reference to Schedule B, which would provide the credits or reimbursements. This Amendment No. 1 to the Denali Unit No. 3 Improvement Agreement will add Schedule B to allow the developer to be reimbursed for the installed improvements in accordance with the P.F.I.P. program.
