Adopt a resolution approving a Services Agreement between the City of Manteca (City) and the Downtown Manteca Improvement Association (DMIA) and authorize the City Manager, or designee, to execute the Agreement on behalf of the City.

Background:

On April 3, 2023, the City approved an agreement with New City America to assist with the formation of a Downtown Community Benefit District. Community Benefit Districts (also known as Property and Business Improvement Districts) offer a mechanism for property owners within these special assessment districts to provide supplemental services, programs, and improvements they might not otherwise have the ability to undertake or afford.

 

On April 2, 2024, City Council approved by Resolution R2024-54, the adoption of a Resolution of Intent to form the Downtown Manteca Community Benefit District (District) and on June 4, 2024, City Council approved Resolution R2024-91, establishing the District.

 

A Services Agreement is necessary to outline the terms of how assessment funds will be transferred from the City to the DMIA, which are used to administer and implement improvements, maintenance, and activities specified in the adopted Manteca Management District Plan, attached herein, as Attachment 2. 

 

At the October 9, 2024, Interim DMIA Board meeting, the proposed Services Agreement, attached herein as Attachment 3, was presented for review and was approved by the Board with an amendment to Section 4.2., which lowered the threshold limit for competitively bid contracts from $25,000 to $15,000. The DMIA Board voted and approved the Services Agreement, as amended. 

 

Fiscal Impact:

Funds have been appropriated in the FY 2024-25 budget in the Development Services Fund (340) for this agreement. The decrease of approximately $41,000 in expenses for this agreement will cover costs associated with the assessments of the City-owned parcels within the District.

 

There is no General Fund impact.
