Subject: Municipal Code Amendment - Title 15.24, Fire Code

Waive the first reading by substitution of the title and introduce an ordinance of the City Council of the City of Manteca repealing and replacing Title 15.24, Fire Code, and adopting by reference the 2025 Edition of the California Fire Code (California Code of Regulations, Title 24, Part 9, including identified appendices), including adoption of local amendments to the Building Standards Code.

Background:
The State's Health and Safety Code Section 17958 mandates that the California Building Standards Commission adopt and publish the State Code (Title 24 California Code of Regulations) every three (3) years. The 2025 State Code, which incorporates the below-listed codes, becomes effective statewide on January 1, 2023. If approved, this Ordinance would amend Title 15.24 of the Manteca Municipal Code by repealing references to prior editions of the State Code and implementing updated code requirements with local amendments.
The specific parts of Title 24, in the 2025 State Code, proposed for adoption by reference with local amendments include the following:
2025 California Fire Code
Staff has analyzed the published codes and found it necessary to propose local amendments tailored to meet the specific climatic, geographical and topographical conditions in the City of Manteca. The Fire Department recommends that changes and modifications be made to the existing State Codes as adopted locally and thus are advising that certain changes and modifications to the 2025 California Fire Code are all reasonably necessary due to local conditions in the City of Manteca. These changes include modifications of an administrative or procedural nature and subjects that are not covered by the codes that are necessary to safeguard life and property within the City of Manteca. An example of these includes fire protection sprinkler systems.
Therefore, the proposed Municipal Code amendment is to Title 15 and would provide for the adoption of the State Codes and local amendments, as well as remove outdated Municipal Code sections that are not necessary, and renumber specific sections for clarity, consistency, and procedural functionality.
Staff recommends the amendment of Title 15 of the Manteca Municipal Code, adopting the 2025 California Fire Code with certain local amendments.
Fiscal Impact:
There is no direct cost to the City associated with adopting this ordinance. Existing fees cover the costs for plan checks, permits, and inspections. The proposed ordinance does not change existing fees.
