Adopt a resolution determining Suarez & Munoz Construction, Inc. to be the lowest responsive and responsible bidder for the Woodward Park Splash Pad and Improvements (CIP 24086), awarding the construction contract including Additive Alternate No. 1, 2 and 3 to Suarez & Munoz Construction, Inc. in the amount of $2,798,000 and approving a project construction contingency not-to exceed $209,850 (7.5%), for a total construction budget of $3,007,850., Amend the Fiscal Year 2025 Capital Improvement Program Project budget (CIP 24086) by authorizing a budget appropriation of $1,700,000 from Park Acquisition and Improvement Fees Fund 500; and authorizing the City Manager or designee to take all appropriate actions necessary to carry out the purpose and intent of the resolution

Background:
The Woodward Park Splash Pad and Improvements Project (CIP 24086) will introduce a splash pad featuring a unique serpentine splash pad, designed to provide a dynamic and visually engaging play area for children and families. The serpentine design will not only create an exciting, flowing water pattern but also serve as a central aesthetic focal point for the park. In addition to the splash pad, the project will include various park improvements, such as replacement of the existing restroom building with a new premanufactured restroom building, a new pump equipment building, upgraded landscaping, enhanced seating areas, improved walkways, and accessible amenities to ensure the space is welcoming and inclusive for all visitors. The project included the additive alternates of shade canopies, walkway to Woodward Avenue and relocation of the existing swing set.
To expedite the project, the Project Plans, Specifications and Cost Estimate were prepared by an outside consultant. City Staff will provide construction management support for this project to optimize expenditure of local funds with some support from an outside consultant for special inspections.
On February 4, 2025, City Council authorized a Call for Construction Bids and approved the Plans, Specifications, and Estimate, for this Project.

The low bid was within the staff’s estimated construction cost range and recommends accepting the Base Bid and Additive Alternate No. 1, 2 and 3, which is the addition of a walkway to Woodward Avenue, shade canopies at the splash pad and relocation of the swings.
Staff requests additional funding of $1,700,000 from Park Acquisition and Improvement Fees Fund 500 be allocated to the CIP 24086 to cover the project design, construction and special inspections along with other miscellaneous expenses.
An additional Phase II of the project is upcoming to relocate the existing restroom structure to the other side of the basin at the Bridewell Parking lot and will be brought to the City Council at a future meeting.
Fiscal Impact:
There is sufficient fund balance in the Park Acquisition and Improvement Fee fund (Fund 500) for the recommended budget appropriation of $1,700,000 for CIP 24086.
The current FY25 Amended budget for the Woodward Park Splash Pad and Improvements Capital Improvement Program Project (CIP 24086) is $2,182,500 (which include budget for project plans, specifications and cost estimates) and is funded between Funds 500 Parks Acquisition & Improvement and Fund 110 Covid Relief (ARPA).
The Suarez & Munoz Construction, Inc. construction award is $2,798,000 and staff recommend approving a project construction contingency of $209,850 (7.5%) for a total not-to-exceed amount of $3,007,850.
