Adopt a resolution approving Amendment No. 2 to the Agreement (C2023-94) with DF Engineering, Inc. increasing the not-to-exceed total from $150,000 to $200,000; and authorizing the City Manager to sign Amendment No. 2 and take all appropriate actions necessary to carry out the purpose and intent of the resolution.

Background:
Under the City Manager’s contract authority, the City of Manteca Engineering Department has utilized DF Engineering, Inc. (Consultant) over the past two years on an as-needed basis to supplement plan checking services when workload and/or staff levels prevent timely delivery of these services by City staff, consistent with department goals. This service helps meet the ebb and flow of development demand in a cost effective and time sensitive manner.
On October 1, 2024, the City Council approved Amendment No. 1 which increased the Consultant’s contract from $75,000 to $150,000 and extended it from December 31, 2024, to June 30, 2025. The current Agreement is nearing the Amendment No. 1 not-to-exceed amount of $150,000 but will not expire until June 30, 2025. To ensure continuity of services, staff recommends increasing the not-to-exceed amount to $200,000. Existing funding from Fund 810 Engineering fund from accounts capital improvements parks improvements and professional services general will be utilized for this amendment.
Fiscal Impact:
Staff recommend the City Council approve Amendment No. 2 for the professional services agreement C2023-94 with DF Engineering in the amount of $50,000 for a total agreement not-to-exceed amount of $200,000, with Amendments 1 & 2, without additional authorization from the City.
The City will pay for the additional plan check services under Amendment No. 2 to the Agreement for Professional Services via development fees collected from the respective developments reviewed, resulting in no net cost to the City.
