Adopt a resolution accepting In-tract and Offsite Public Improvements for Denali Subdivision, Unit No. 2 (Tract 4100); approving exoneration of the Performance Bonds; approving exoneration of the Labor and Materials Bonds six (6) months after the date of acceptance; and approving exoneration of the Warranty Bonds twelve (12) months after the date of acceptance.

Background:
The City Council approved the Final Map for Denali Unit No. 2 and the Improvement Agreements for the Denali Unit No. 2 In-tract Improvements and the Denali Unit No. 2 Offsite Improvements on June 21, 2022. The Unit No. 2 Final Map subdivided approximately 42.51 acres of land into 142 residential lots, a park/storm drain basin lot, landscape lots, a well lot and public rights-of-way. The estimated cost of the In-tract improvements is $12,766,659.20 and the estimated cost of the Offsite improvements is $7,814,014.21, as included in the Improvement Agreements.
The installed improvements include all underground utilities (both wet and dry), curb, gutter, sidewalk, street pavement, street markings, street signage, street lighting, sewage systems, storm drainage systems, water systems, perimeter fencing and the park.
The In-tract and Offsite public improvements for the Denali Subdivision, Unit No. 2, have been completed in accordance with the approved Improvement Plans. Refer to the attached memorandum from the City Construction Inspector (Attachment 2).
In accordance with the City of Manteca Municipal Code, the Performance Bonds will be exonerated upon acceptance of the improvements by City Council and submittal of Warranty Bonds. The Labor and Materials Bonds will be exonerated six (6) months after the date of acceptance if no claims have been received by the City for lack of payment. The Warranty Bonds will be exonerated twelve (12) months after the date of acceptance, once the improvements have been re-inspected and the work is found to be in good condition as determined by the City Engineer or any defects have been repaired.
Fiscal Impact:
There is no fiscal impact associated with this action.
