Background:

 

The proposed ordinance amendment is in response to recent citizen complaints regarding unsafe bicycle activity throughout the City of Manteca and nearby highways.  Large groups of bicyclists have been observed interfering with traffic, riding on the highway in front of oncoming traffic, driving recklessly, and causing safety hazards to public roadways and the community.  

 

Due to these recent events, City staff recommends amending the current bicycle ordinance to address these public safety concerns.  The proposed amendment will restrict organized, planned, or street takeovers, and a violation may result in a misdemeanor subject to a $1,000 fine.  The organizer or promoter of such an event may also be subject to a misdemeanor and a $1,000 fine. 

 

In addition, the amendment authorizes the Police Chief to require any minor who operates a bicycle in an illegal manner or that otherwise violates the Municipal Code or Vehicle Code to attend a bicycle operator’s school.  Lastly, the amendment will allow the Police Department to impound bicycles when the owner violates this new section. 

 

This proposed amendment will provide the Police Department with an additional mechanism of enforcement, particularly to address the most recent activity involving street takeovers.
