Adopt a resolution approving an agreement with Eckert Cold Storage to discharge its industrial wastewater to a dedicated collection and disposal system effective January 1, 2026, to December 31, 2028, with annual fixed payment to the City in the amount of $203,378, subject to annual increases, and variable costs paid to the City.

Background:
Eckert Cold Storage (Eckert) is a food processor in the City of Manteca (City), discharging its industrial wastewater to a dedicated collection and disposal system, known as the Industrial Sewer System. The Industrial Sewer System conveys Eckert's industrial wastewater around the City's sanitary sewer collection system and the City's Wastewater Quality Control Facility (WQCF) into a lined pond to be aerated then discharged to City owned farmland adjacent to the WQCF. In 2009, City Council adopted Ordinance No. 1439, establishing the industrial sewer service charges for Eckert to cover the operation and maintenance costs of the dedicated pipeline and treatment. This process has been active annually since 2009, and the ordinance has been updated through the years.
Staff met with Eckert regarding the future operation of their business. It was determined an agreement through December 31, 2028, instead of an annually amended ordinance, is the best way to facilitate the disposal of their wastewater. Staff recommend entering into the agreement with Eckert.
Fiscal Impact:
The cost to provide this service is paid from the Sewer O&M Fund (Fund 640) and will be recovered directly from Eckert. The cost recovery for 2026 is $203,378. This amount will be adjusted annually based on the Eng...
