Adopt a resolution accepting Public Improvements for The Crossing - Manteca at South Airport and West Atherton; approving exoneration of the Performance Bond; approving exoneration of the Labor and Materials Bond six (6) months after the date of acceptance; and approving exoneration of the Warranty Bond twelve (12) months after the date of acceptance.

Background:
The City Council approved The Crossing - Manteca commercial development on June 1, 2023 and subsequently approved the Improvement Agreement for constructing offsite transportation improvements on April 2, 2024.
The offsite improvements are located on S. Airport Way and W. Atherton Drive and include street resurfacing, traffic signal improvements for S. Airport Way at W. Atherton Drive and Langum Way at W. Atherton Drive; medians; signing & striping; drainage facilities; street lights; and utilities. Per the Improvement Agreement, the cost of these transportation improvements is $2,975,990.
The public improvements for The Crossing - Manteca have been completed in accordance with the approved improvement plans. Refer to the attached memorandum from the City Construction Inspector (Attachment 2).
In accordance with the City of Manteca Municipal Code, the Performance Bond will be exonerated upon acceptance of the improvements by City Council and submittal of a Warranty Bond. The Labor and Materials Bond will be exonerated six (6) months after the date of acceptance if no claims have been received by the City for lack of payment.
