Subject: |
Drainage Ditch Easement Quitclaim for the Farmhouse Subdivision |
Recommendation:
title
Adopt a resolution accepting a Quitclaim from: Jack Lewis (also known as Joaquin Lewis II), a married man as his sole and separate property; Jennifer Lynn Nunes, a married woman as her sole and separate property; and James Francis Lewis, a married man as his sole and separate property; for a Drainage Ditch Easement across the Al Fonseca Lane right-of-way, over 1927 Al Fonseca Lane and 1432 Maehl Drive.
body
Background:
The Owners of the Farmhouse Tentative Map filed a Parcel Map to separate the future development portion of the Tentative Map from the lots that will be retained by the Lewis Family. A requirement for the recordation of the Parcel Map was to record a Minor Subdivision Restriction in which the development will be required to remove an existing Drainage Ditch Easement which encumbers the southern 20’ of the Woodward Estates subdivision to the west of the Farmhouse Tentative Map. The easement affects seven residential lots, the Al Fonseca right-of-way, and portions of Palmer Park at 1927 Al Fonseca Lane and 1432 Maehl Drive.
With this action, the owners of the Farmhouse Tentative Map will be quitclaiming their interests in the easement within the Al Fonseca right-of-way (over 1927 Al Fonseca Lane and over 1432 Maehl Drive) to the City. Removal of the easement from the seven affected residential properties will be processed administratively.
Fiscal Impact:
There is no fiscal impact associated with this action.
