Recommendation:

Adopt a resolution accepting all improvements for the Woodward Park Splash Pad - Phase II Restroom Relocation Project (CIP 24086) as complete, authorizing the City Clerk to file the Notice of Completion, and authorizing the City Manager or designee to complete and execute all associated documents, and take all appropriate actions necessary to carry out the purpose and intent of the resolution.

Background:
On June 17, 2025, City Council awarded the construction contract C2025-130 for the Woodward Park Splash Pad and Improvements (CIP 24086) to Suarez & Munoz Construction, Inc. in the amount of $679,000 and approving a project construction contingency not-to exceed $67,900 (10%), for a total construction budget of $746,900.
The Project had 1 change order. Change order number 1 was in the amount of $38,143.60 which included a total of 8 preliminary change orders (Attachment 3)
The Project was constructed in general conformance with the conformed plans and specifications.
The final project construction cost is $717,143.60; the Contractor has submitted the signed final payment certification (Attachment 4).
The total retention of $35,857.17 will be released to the Contractor no sooner than 45 days after filing the notice of completion (Attachment 2).
Fiscal Impact:
There is sufficient funding in the Park Acquisition and Improvement Fee Fund (Fund 500) for this item.
