Background:

On April 15, 2025, the City Council adopted Urgency Ordinance No. O2025-06, establishing a temporary moratorium on the establishment of new, and relocation or expansion, of existing tobacco retailer businesses, also known as smoke shops. This Ordinance was adopted pursuant to Government Code sections 65858 and 36937. Subsection (d) of section 65858 requires, “ten days prior to the expiration of that interim ordinance or any extension, the legislative body shall issue a written report describing the measures taken to alleviate the condition which led to the adoption of the ordinance.”

 

The attached report summarizes the City of Manteca’s efforts to alleviate the condition described in the Urgency Ordinance, and to comply with the requirement of Subsection (d) of section 65858.
