Background:
The City of Manteca (“City”) owns real property located at 103, 107, and 115 W. Yosemite Avenue in downtown Manteca (APN’s: 217-210-470, 217-210-480 and 217-210-490), consisting of approximately 0.15, 0.07, and 0.13 acres, respectively (total of ~0.354 acres) (“Properties”).

The California Surplus Land Act (“SLA”), Government Code Sections 54220 et seq., requires local agencies to declare property as either “surplus land” or “exempt surplus land” before taking action to sell or lease the property. Amendments to the SLA that became effective January 1, 2024, further clarified the categories of property that qualify as exempt surplus land.

Government Code Section 54221(f)(1)(B) provides an exemption for surplus land that is less than one-half acre and is not contiguous to land owned by a state or local agency that is used for open-space or low- and moderate-income housing purposes. The Properties total approximately 0.354 acres and meet the applicable criteria for designation as exempt surplus land.

Staff recommends that the City Council declare the Properties exempt surplus land and authorize completion of the applicable surplus property disposition process in accordance with the SLA.
