Adopt a resolution approving a cooperative agreement between the City of Manteca and the San Joaquin Council of Governments for the SR99/120 Phase 1A Improvements Project; Approving a Budget Appropriation of $3,229,000 in the City's Regional Transportation Impact Fee Fund (Fund 430); and authorizing the City Manager or Designee to take all appropriate actions necessary to carry out the purpose and intent of the resolution.

Background:
The San Joaquin Council of Governments (SJCOG) is the lead agency for the SR99/120 Connector Project, which will provide safety and capacity improvements to the state highway system in the greater area where SR99 and SR120 connect. Earlier in the project's development phase, the City of Manteca identified the need to increase the capacity of the Austin Road overcrossing of SR99 from 2 lanes to 4 lanes, to meet the demands of the City's proposed Austin Industrial Park area on the west side of SR99. SJCOG concurred with the request and the widening of this overcrossing was included in the current project under construction.
Through negotiations between the City and SJCOG, the City's cost share for this request was determined to be approximately 6.7% of the awarded construction contract, or $3,229,000. The City identified the source of the funds to be its Regional Transportation Impact Fee (RTIF), which is collected from new development as it occurs and is intended to help fund transportation projects and improvements of a regional nature. SJCOG has concurred with the RTIF funding source determination.
