Approve the Second Amendment to Communications Site Lease Agreement (Ground and Tower) for the radio tower at Fire Station 2, 1154 S. Union Road, between the City of Manteca and T-Mobile West LLC; and authorize the City Manager to sign and take all necessary steps to effectuate the amendment.

Background:
The City and T-Mobile West LLC, or their predecessors, entered into a Communications Site Lease Agreement (Ground and Tower) dated December 17, 2008, and a restatement and first amendment dated December 17, 2008, for leased space at 1154 S. Union Road. The site is the radio tower at Fire Station 2. The proposed second amendment would replace the existing renewal schedule and revise rent and certain administrative terms. Under the amendment, the current and remaining renewal terms end September 30, 2026.
The amendment grants the tenant seven additional five-year renewal terms beginning October 1, 2026. Rent will be $2,600 per month beginning that date and will increase by 15 percent on October 1, 2031, and at the start of each subsequent five-year renewal term. If the tenant remains after the agreement ends, the lease will be converted to a month-to-month tenancy on the same terms.
T-Mobile would continue to use the leased ground and tower space for its communications equipment. The tenant would maintain its leased space and equipment, while the City would maintain the remainder of the property, including any City-owned support structure, landscaping, and common areas where applicable.
