Adopt a resolution approving the Improvement Agreement for the construction of the Woodward Avenue Sewer Trunk Main located on Woodward Avenue, approximately 100 feet east of Pagola Way to the intersection of South Main Street and authorize the City Manager or designee to sign and take all necessary steps to effectuate the Agreement.

Background:
On March 21, 2023, the City Council conditionally approved the Yosemite Square Tentative Subdivision Map. The map proposed to subdivide 137.5 acres of land into 797 residential lots, 19.96 acres of open space and 6.74 acres of park land. As a condition of the approval, the developer was required to construct certain offsite improvements for the project, including street widening, water line extensions, sewer line extensions, and pump stations.
At this time the owner/developer of Yosemite Square is seeking to enter into an Improvement Agreement for that certain work to install the sewer trunk main in Woodward Avenue. This work will complete the final section of sanitary sewer & storm drain trunk main for the Woodward Avenue Sewer & Storm Drain Project originally started in 2013.
In accordance with Title 16, Section 16.23.080 of the City of Manteca Municipal Code, the developer for the Yosemite Square Subdivision has worked with the City to complete the agreements and will submit the required bonds prior to the start of work.
Due to the nature of the installation of the sanitary sewer main in Woodward, certain other improvements are necessary for the restoration and improvement to Woodward Avenue.
