Background:
On June 19, 2018, City Council approved the Tentative Map for Oakwood Landing, which includes the Cerri Subdivision. Because this area is within the Zone 39 Storm Drain Area, there is currently no terminal storm drain outfall for this zone. In accordance with the project Conditions of Approval and the City's Storm Drain Master Plan (SDMP), the Developer has constructed an interim percolation basin that will receive the storm drain flows for the entire Cerri subdivision until the terminal outfall is constructed.

In accordance with the SDMP, the Developer is responsible for the maintenance of the basin and must enter into an agreement with the City accepting the maintenance responsibility and giving the City the authority to inspect and cause repairs to be made to the basin.

The Developer has worked with the City to complete the agreement, which has been reviewed by the City Attorney.

On January 19, 2021, City Council approved the Final Map and Improvement Agreement for the Cerri Unit No. 2 subdivision.

In accordance with the City's Partial Acceptance Policy, all health and safety items in the Unit have been completed. The one year warranty period will not start and the developer is still responsible for the maintenance of the improvements until the improvements are fully accepted by City Council.

Fiscal Impact:
There is no fiscal impact associated with this action.
