Background:

Since 2002, the City of Manteca has provided the City of Lathrop services regarding the use of Manteca’s animal shelter. In 2012, the original contract between the parties was revised and updated, but was not brought before the Manteca City Council for approval. The contract continued to be renewed annually based on the language of the agreement.

In early 2021, the Manteca Police Department and its Animal Services Division began to review the terms of the prior contract, which included an annual payment made to the City of Manteca of $60,000/year. The Manteca Police Department, in working with the City of Lathrop staff, negotiated a new annual payment of $94,587/year.

In the summer of 2021, the City Attorney’s Office for Manteca and the City of Manteca’s Risk Management Office worked with the City of Lathrop to revise the general terms and conditions of the agreement, and adjust the insurance amounts to be consistent with what is requested from the City of Manteca’s insurer. Following good faith negotiations between the parties, the attached terms and conditions were agreed to.

In addition, the City of Manteca recognized that in the near future, as Manteca brings into its fold anywhere from 800-1000 new homes per year, the Manteca Animal Shelter will be nearing capacity based on the statistics that show close to 40% of homeowners in California own at least one (1) pet at their home, and that some of those animals will likely end up at the Manteca Shelter. Accordingly, Manteca Staff advised Lathrop Staff that Manteca will need transition away from providing animal shelter services to Lathrop in the near future.

The instant agreement between the cities has a term of one (1) year (October 1, 2021 through September 30, 2022), with an option to extend the agreement for up to an additional three (3) months if mutually agreed upon by the parties in writing. The City of Manteca Staff submits that this time period shall not only provide Lathrop sufficient time to transition to a new shelter provider, but will also allow City of Manteca staff sufficient time to pivot and get ready for the influx of new Manteca residents (and their animals) over the next several years.

Fiscal Impact:

The agreement will provide the City of Manteca with $94,587 in exchange for providing animal shelter services to the City of Lathrop - an increase of $34,587 (or 57.6%) from the previous contract.
